These Terms of Use ("Terms") govern your access to and use of jahnathanjones.com (the "Site"), operated by Jahnathan Jones, a sole proprietor doing business under his own name ("we," "us," or "our"). The Site is an illustration portfolio and commission business that may also offer prints, originals, and other products through its Shop.

By using the Site, you agree to these Terms and to our Privacy Policy. If you do not agree, please do not use the Site.

1. Use of the Site

You may use the Site to view artwork, learn about our work, submit commission requests, contact us, and make purchases when the Shop is available. You must be at least 13 years old to use the Site. To place an order or request a commission, you must be at least 18 years old or have the permission of a parent or legal guardian.

2. Ownership of Artwork and Content

All artwork, illustrations, creature designs, sketches, images, text, logos, and other content on the Site are owned by Jahnathan Jones and are protected by United States and international copyright and intellectual property laws. Viewing the Site does not give you any ownership of or license to use this content. © 2026 Jahnathan Jones. All rights reserved.

Purchasing a print, original, or other product transfers ownership of the physical item only. It does not transfer the copyright or any right to reproduce, distribute, or commercially use the artwork.

3. Prohibited Uses of Artwork

Unless you have our written permission, you may not:

  • Copy, download, reproduce, print, or distribute any artwork for any purpose other than personal viewing;

  • Sell, license, or use any artwork on products, merchandise, book covers, posters, logos, tattoos, or digital collectibles;

  • Modify, trace, edit, or create derivative works based on any artwork;

  • Remove or alter any signature, watermark, or copyright notice;

  • Use any artwork or content to train, fine tune, or prompt artificial intelligence or machine learning systems, or collect content from the Site using bots, scrapers, or other automated tools;

  • Present any artwork as your own or suggest that we endorse you or your work.

You are welcome to share images of our artwork on social media for noncommercial purposes, as long as the image is unaltered and you clearly credit Jahnathan Jones and link back to the Site or our official social media account.

4. Commissions

Submitting a commission request through the Site does not create a contract or obligate either party to move forward. Every accepted commission is governed by a separate written quote or agreement that covers the scope of work, fees, deposits, revisions, timeline, and usage rights. If that agreement differs from these Terms, the agreement controls for that commission.

Unless your commission agreement states otherwise, Jahnathan Jones keeps the copyright to all commissioned artwork, including sketches and concept work, and may display the finished piece in his portfolio, on social media, and in promotional materials. You receive the specific usage rights described in your commission agreement.

5. Shop, Orders, and Payment

The Shop is coming soon. Once it is available, the following terms apply to all purchases:

  • Orders are processed through Squarespace and a third party payment processor, such as Stripe or PayPal.

  • Prices, product descriptions, and availability may change at any time without notice.

  • We may refuse or cancel any order, including orders affected by pricing or listing errors or suspected fraud. If we cancel an order after you have paid, you will receive a full refund.

  • Colors shown on screen may differ slightly from printed or original pieces because of monitor and printing differences.

  • Limited editions are produced only in the quantities stated at the time of sale.

  • Shipping, return, and refund terms shown on the Shop page or at checkout apply to your order.

6. Your Submissions

When you send us project ideas, reference images, or other materials, you confirm that you have the right to share them. You give us permission to use those materials only to review and complete your request. We do not claim ownership of the materials you send us.

7. Third Party Links and Social Media

The Site links to third party websites and social media platforms, including Instagram, Pinterest, X, YouTube, Facebook, and TikTok. Those platforms are governed by their own terms and policies, and we are not responsible for their content or practices.

8. Disclaimer of Warranties

The Site and its content are provided "as is" and "as available," without warranties of any kind, either express or implied. We do not guarantee that the Site will be uninterrupted, error free, or free of viruses or other harmful components.

9. Limitation of Liability

To the fullest extent permitted by law, Jahnathan Jones will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Site, your purchases, or any commission. Our total liability for any claim will not exceed the amount you paid us for the product or service that gave rise to the claim.

10. Indemnification

You agree to indemnify and hold harmless Jahnathan Jones from any claims, losses, or expenses, including reasonable attorneys' fees, arising from your misuse of the Site, your misuse of our artwork, or your violation of these Terms.

11. Governing Law

Jahnathan Jones operates as a sole proprietor based in California. These Terms, and any dispute arising from them or from your use of the Site, are governed by the laws of the State of California, without regard to its conflict of law principles. Any dispute will be resolved in the state or federal courts located in California.

12. Privacy

Your use of the Site is also governed by our Privacy Policy, which explains how we collect, use, and protect your information.

13. Changes to These Terms

We may update these Terms from time to time. We will post the updated Terms on this page with a revised "Last Updated" date. Your continued use of the Site after changes are posted means you accept the updated Terms.
